NOTICE AND DESCRIPTION OF SHELLFISH AREA CONDEMNATION
NUMBER 010-105, LITTLE WICOMICO RIVER, UPPER
EFFECTIVE 15 AUGUST 2025
Pursuant to Title 28.2, Chapter 8, §§ 28.2-803 through 28.2-808, § 32.1-20, and § 2.2-4002, B.16 of the Code of Virginia:
1. The “Notice and Description of Shellfish Area Condemnation Number 010-105, Little Wicomico River,” effective 15 July 2023, is cancelled effective 15 August 2025.
2. Condemned Shellfish Area Number 010-105, shown as Sections A through D, is hereby established effective 15 August 2025. It shall be unlawful for any person, firm, or corporation to take shellfish from these areas for any purpose, except by permit granted by the Marine Resources Commission, as provided in § 28.2-810 of the Code of Virginia. The boundaries of these areas are shown on the maps titled “Little Wicomico River, Upper, Condemned Shellfish Area Number 010-105, 15 August 2025” which is part of this notice.
3. Conditionally Approved (Seasonally Closed Status) Shellfish Area Number 010-105, shown as Section M1, is hereby established effective 15 August 2025, and shall remain in force annually thereafter for the period beginning the first day of April through the last day of October until rescinded. It shall be unlawful for any person, firm or corporation to take shellfish from this area during such period for any purpose while in the closed status, except by permit granted by the Marine Resources Commission, as provided in § 28.2-810 of the Code of Virginia. The boundaries of this area are shown on the maps titled “Little Wicomico River, Upper, Condemned Shellfish Area Number 010-105 15 August 2025” which is part of this notice.
4. Conditionally Approved (Closed Status) Shellfish Area Number 010-105, shown as Section M2, is hereby established effective 15 August 2025. It shall be unlawful for any person, firm or corporation to take shellfish from this area during such period for any purpose while in the closed status, except by permit granted by the Marine Resources Commission, as provided in § 28.2-810 of the Code of Virginia. The boundaries of this area are shown on the maps titled “Little Wicomico River, Upper, Condemned Shellfish Area Number 010-105 15 August 2025” which is part of this notice.
5. The Department of Health will receive, consider and respond to petitions by any interested person at any time with respect to reconsideration or revision of this order.
BOUNDARIES OF CONDEMNED AREA NUMBER 010-105
A. The condemned area shall include that portion of the Little Wicomico River and its tributaries upstream of a line drawn between latitude / longitude map coordinate (37°53'49.4",-76°18'19.7") and map coordinate (37°53'54.1",-76°17'53.6").
B. The condemned area shall include that portion of Cod Creek and its tributaries upstream of a line drawn between latitude / longitude map coordinate (37°53'07.4",-76°17'47.1") and map coordinate (37°53'05.4",-76°17'42.6").
C. The condemned area shall include all of Sloop Creek and its tributaries upstream of a line drawn between latitude / longitude map coordinate (37°53'24.2",-76°17'53.8") and map coordinate (37°53'23.0",-76°17'53.6").
D. The condemned area shall include all of Back Creek and its tributaries upstream of a line drawn between latitude / longitude map coordinate (37°53'09.9",-76°16'59.2") and map coordinate (37°53'10.6",-76°16'58.7").
M1. The conditionally approved area (seasonally closed status) shall include that portion of the Little Wicomico River inland of a line drawn between latitude / longitude map coordinate (37°53'21.7",-76°17'15.0"), map coordinate (37°53'22.6",-76°17'14.5"), map coordinate (37°53'17.7",-76°17'02.1"), and map coordinate (37°53'16.5",-76°17'02.9").
M2. The conditionally approved area (closed status) shall include that portion of the Little Wicomico River inland of a line drawn between latitude / longitude map coordinate (37°53'57.5",-76°18'13.0"), map coordinate (37°53'56.8",-76°18'15.7"), map coordinate (37°53'50.9",-76°18'11.7"), map coordinate (37°53'52.0",-76°18'05.4"), and map coordinate (37°53'57.1",-76°18'02.3"); but is shown in the report only.
