NOTICE AND DESCRIPTION OF SHELLFISH AREA CONDEMNATION
NUMBER 012-002, COCKRELL CREEK
EFFECTIVE 15 OCTOBER 2025
Pursuant to Title 28.2, Chapter 8, §§ 28.2-803 through 28.2-808, § 32.1-20, and § 2.2-4002, B.16 of the Code of Virginia.
1. The “Notice and Description of Shellfish Area Condemnation Number 012-002, Cockrell Creek,” effective 15 May 2024, is cancelled effective 15 October 2025.
2. Condemned Shellfish Area Number 012-002, shown as Sections A through D, is established effective 15 October 2025. As to Sections A through C; it shall be unlawful for any person, firm, or corporation to take shellfish from these areas for any purpose, except by permit granted by the Marine Resources Commission, as provided in § 28.2-810 of the Code of Virginia. As to Section D, it shall be unlawful for any person, firm, or corporation to take shellfish from this area for any purpose. The boundaries of these areas are shown on the map titled “Cockrell Creek, Condemned Shellfish Area Number 012-002, 15 October 2025” which is part of this notice.
3. Conditionally Approved Shellfish Area (Closed Status) Number 012-002, shown as Sections M1 through M5, is hereby established effective 15 October 2025, and shall remain in force annually thereafter until rescinded. It shall be unlawful for any person, firm or corporation to take shellfish from these areas during such period for any purpose, except by permit granted by the Marine Resources Commission, as provided in § 28.2-810 of the Code of Virginia. The boundaries of these areas are shown on the map titled “Cockrell Creek, Condemned Shellfish Area Number 012-002, 15 October 2025” which is part of this notice.
4. The Department of Health will receive, consider and respond to petitions by any interested person at any time with respect to reconsideration or revision of this order.
BOUNDARIES OF CONDEMNED AREA NUMBER 012-002
A. The condemned area shall include that portion of Cockrell Creek and its tributaries upstream of a line drawn from latitude/longitude map coordinate (37°49'37.2",-76°16'58.7") to map coordinate (37°49'31.6",-76°16'32.5"); but excludes the areas defined as Sections B and D.
B. The condemned area shall include that portion of Cockrell Creek and its tributaries upstream of a line drawn from latitude/longitude map coordinate (37°50'09.2",-76°16'53.1") to map coordinate (37°50'11.0",-76°16'36.1").
C. The condemned area shall include that portion of Whays Creek upstream of a line drawn between latitude / longitude map coordinate (37°50'31.1",-76°18'37.5") and map coordinate (37°50'29.5",-76°18'34.1").
D. The condemned area shall include that portion of Cockrell Creek and its tributaries upstream of a line drawn from latitude/longitude map coordinate (37°50'06.4",-76°16'50.5") to map coordinate (37°49'56.4",-76°16'37.4"); but excludes the area defined as Section B.
M1. The conditionally approved area (closed status) shall include that portion of Cockrell Creek inland of a line drawn between latitude / longitude map coordinate (37°49'46.8",-76°16'41.7"), map coordinate (37°49'47.3",-76°16'45.7"), map coordinate (37°49'40.5",-76°16'47.0"), and map coordinate (37°49'39.9",-76°16'41.0"); and is shown as part of Section A.
M2. The conditionally approved area (closed status) shall include that portion of an unnamed tributary of Cockrell Creek inland of a line drawn between latitude / longitude map coordinate (37°50'22.6",-76°15'57.7"), map coordinate (37°50'21.6",-76°15'59.8"), and map coordinate (37°50'18.5",-76°15'57.7"); and is shown as part of Section B.
M3. The conditionally approved area (closed status) shall include that portion of Cockrell Creek inland of a line drawn between latitude / longitude map coordinate (37°50'20.1",-76°16'46.6"), map coordinate (37°50'19.5",-76°16'50.4"), map coordinate (37°50'13.4",-76°16'48.4"), map coordinate (37°50'14.6",-76°16'43.1"), and map coordinate (37°50'16.5",-76°16'43.8"); and is shown as part of Section B.
M4. The conditionally approved area (closed status) shall include include that portion of an unnamed tributary of Cockrell Creek inland and upstream of a line drawn between latitude / longitude map coordinate (37°50'27.7",-76°17'08.1"), map coordinate (37°50'25.7",-76°17'15.4"), and map coordinate (37°50'32.2",-76°17'18.0"); as well as inland and downstream of a second line drawn between map coordinate (37°50'37.3",-76°17'16.8") and map coordinate (37°50'35.2",-76°17'18.8"); and is shown as part of Section B.
M5. The conditionally approved area (closed status) shall include that portion of Cockrell Creek inland of a line drawn between latitude / longitude map coordinate (37°49'59.3",-76°17'05.4") and map coordinate (37°49'50.7",-76°17'04.5"); and is shown as part of Section A.
