NOTICE AND DESCRIPTION OF SHELLFISH AREA CONDEMNATION
NUMBER 016-057, INDIAN CREEK
EFFECTIVE 15 FEBRUARY 2026
Pursuant to Title 28.2, Chapter 8, §§ 28.2-803 through 28.2-808, § 32.1-20, and § 2.2-4002, B.16 of the Code of Virginia.
1. The “Notice and Description of Shellfish Area Condemnation Number 016-057, Indian Creek,” effective 15 December 2024, is cancelled effective 15 February 2026.
2. Condemned Shellfish Area Number 016-057, shown as Sections A through E, is hereby established, effective 15 February 2026. As to Sections A through D, it shall be unlawful for any person, firm, or corporation to take shellfish from these areas for any purpose, except by permit granted by the Marine Resources Commission, as provided in § 28.2-810 of the Code of Virginia. As to Section E, it shall be unlawful for any person, firm or corporation to take shellfish from this area, for any purpose. The boundaries of these areas are shown on the map titled “Indian Creek, Condemned Shellfish Area Number 016-057, 15 February 2026” which is part of this notice.
3. Conditionally Approved Shellfish Area (seasonally closed status) Number 016-057, shown as Sections M1 and M2, is hereby established effective 15 February 2026, and shall remain in force annually thereafter for the period beginning the first day of April through the last day of October until rescinded. It shall be unlawful for any person, firm or corporation to take shellfish from these areas while in the closed status, except by permit granted by the Marine Resources Commission, as provided in § 28.2-810 of the Code of Virginia. The boundaries of these areas are shown on the map titled “Indian Creek, Condemned Shellfish Area Number 016-057, 15 February 2026” which is part of this notice.
4. Conditionally Approved Shellfish Area (closed status) Number 016-057, shown as Sections M3 and M4, is hereby established effective 15 February 2026, and shall remain in force until rescinded. It shall be unlawful for any person, firm or corporation to take shellfish from these areas while in the closed status, except by permit granted by the Marine Resources Commission, as provided in § 28.2-810 of the Code of Virginia. The boundaries of these areas are shown on the map titled “Indian Creek, Condemned Shellfish Area Number 016-057, 15 February 2026” which is part of this notice.
5. The Department of Health will receive, consider and respond to petitions by any interested person at any time with respect to reconsideration or revision of this order.
BOUNDARIES OF CONDEMNED AREA NUMBER 016-057
A. The condemned area shall include that portion of Indian Creek inland of a line drawn between latitude / longitude map coordinate (37°41'47.8",-76°21'01.1") and map coordinate (37°41'51.2",-76°20'53.2"); but excludes the area defined as Section E.
B. The condemned area shall include all of Long Cove and its tributaries upstream of a line drawn between latitude / longitude map coordinate (37°41'20.2",-76°20'46.5") and map coordinate (37°41'18.8",-76°20'45.0").
C. The condemned area shall include all of Pittmans Cove and its tributaries upstream of line drawn between map coordinate (37°41'37.0",-76°21'04.0") and map coordinate (37°41'33.0",-76°20'59.2").
D. The condemned area shall include that portion of Henrys Creek upstream of line drawn between map coordinate (37°41'34.4",-76°19'39.7") and map coordinate (37°41'36.7",-76°19'36.1").
E. The condemned area shall include that portion of Indian Creek and its tributaries upstream of a line drawn between latitude / longitude map coordinate (37°42'17.0",-76°21'20.4") and map coordinate (37°42'14.2",-76°21'21.3").
M1. The conditionally approved (seasonally closed status) area shall include that portion of Indian Creek inland of a line drawn between latitude / longitude map coordinate (37°41'29.6",-76°20'26.9") and map coordinate (37°41'24.9",-76°20'20.0").
M2. The conditionally approved (seasonally closed status) area shall include that portion of Bells Creek inland of a line drawn between latitude / longitude map coordinate (37°41'22.4",-76°20'01.2"), map coordinate (37°41'23.9",-76°20'02.0"). map coordinate (37°41'22.0",-76°20'07.7"), map coordinate (37°41'17.7",-76°20'05.9"), and map coordinate (37°41'18.3",-76°20'03.2").
M3. The conditionally approved (closed status) area shall include that portion of Indian Creek inland and upstream of a line drawn between latitude / longitude map coordinate (37°42'02.4",-76°21'02.8"), map coordinate (37°41'59.3",-76°20'56.1") and map coordinate (37°41'52.1",-76°21'02.1"), as well as inland and downstream of second line drawn between map coordinate (37°41'53.5",-76°21'08.8"), map coordinate (37°41'57.2",-76°21'13.7"), and map coordinate (37°41'59.0",-76°21'11.5"); and is shown as part of Section A.
M4. The conditionally approved (closed status) area shall include that portion of Pittmans Cove inland oa a line drawn between latitude / longitude map coordinate (37°41'27.4",-76°21'23.7"), map coordinate (37°41'28.5",-76°21'23.9"), map coordinate (37°41'29.2",-76°21'12.9"), map coordinate (37°41'24.4",-76°21'11.5"), and map coordinate (37°41'24.0",-76°21'13.8"); and is shown as part of Section C.
